Dayly Terms of Use

These Terms of Use ("Terms") govern your use of the Dayly mobile app and related Dayly services (the "Service"). They are between you and Fombo Network Co., Ltd ("Dayly," "we," "us," or "our").

Please read these Terms before using the Service. By accepting these Terms or using the Service after being given a reasonable opportunity to review them, you agree to them. If you do not agree, do not use the Service. Your mandatory consumer rights remain in place.

1. Who may use Dayly

You must be at least 18 years old, legally able to enter this agreement, and located in a region where the Service is made available. Dayly is designed for adults planning meals for their households.

When you enter information about another person, you must have the authority and any permission required to provide that information for the uses explained in our Privacy Policy. For children, this includes appropriate parental or guardian authority. Family meal planning does not authorize children to use Dayly independently.

No Dayly account is currently required. You are responsible for controlling access to your device and store account and for providing accurate, current meal-planning information.

2. What the Service provides

Dayly provides meal-planning suggestions, recipes, grocery lists, pantry management, ingredient recognition from photos, cooking aids, and related features. Some features use AI and remote services; others use local content and processing.

Features, available content, and usage limits may vary by app version, platform, region, subscription, or offer. We may apply reasonable limits to requests to manage capacity, cost, and misuse. Any material limit on a paid offer should be disclosed before purchase. A subscription does not mean unlimited AI generation unless the offer expressly says so.

We do not sell or deliver groceries through the current app. Store preferences, food prices, portion sizes, cooking times, and nutritional values are estimates. Local availability, brands, taxes, preparation methods, and individual needs can change the actual result.

3. Food safety and health information

Dayly is a meal-planning tool, not a medical service. It does not diagnose, treat, cure, or prevent a condition, prescribe a diet, or replace a qualified clinician or registered dietitian. No professional-patient relationship is created by using the Service.

Do not rely on Dayly as the sole check for an allergy, intolerance, or other dietary risk. AI output, ingredient matching, recipe data, and photo recognition can be incomplete or wrong. An “allergen checked,” “avoids,” dietary label, or similar indication reflects checks against available information; it is not a certification that a dish is safe for a particular person or free of cross-contact.

Before buying, preparing, or serving food:

If a suggestion conflicts with a label, your professional advice, or a known restriction, do not use it. For a suspected serious allergic reaction or other emergency, contact local emergency services and follow your established emergency care instructions.

Calories, protein, costs, and portion estimates may be inaccurate and are not laboratory or clinical measurements. Generated food images are illustrations and may differ from the ingredients or appearance of the actual dish. Cooking timers and reminders are convenience features; supervise cooking and use appropriate food-safety checks.

These explanations describe the Service's limitations. They do not remove any duty or liability that applicable law does not allow us to exclude.

4. AI content and your inputs

AI-generated content may be inaccurate, incomplete, inappropriate, or similar to content provided to someone else. Review the result before using or sharing it. We do not guarantee that a generated recipe or image is unique or eligible for exclusive intellectual-property protection.

You retain any rights you hold in the information, photos, and other content you submit. You give us permission to process that content and provide it to the service providers described in the Privacy Policy only as needed to operate the requested features and fulfill applicable legal obligations. This permission does not transfer ownership of your uploaded photos to us or permit us to use them as public advertising material.

Generated recipe illustrations and titles may be cached and reused across Dayly users, as described in the Privacy Policy. Your uploaded fridge photo is not placed in that shared illustration cache.

You must have the necessary rights and permissions to upload or share content. Avoid including unrelated personal details in photos or free-text fields. These Terms do not replace any separate privacy or sensitive-data consent required by law.

5. Subscriptions, trials, and payment

Prices and access

Some features require a paid subscription. The purchase screen and store confirmation identify the actual product, price, billing period, included features, and any trial or introductory offer. The store's confirmed terms govern your purchase. Prices may vary by country, currency, taxes, or eligibility.

Payment is handled through the Apple App Store or Google Play, as applicable, using your store account and payment method. Adapty helps Dayly verify purchases and determine access. We do not collect your full payment-card number.

Automatic renewal

An auto-renewing subscription continues and charges for each new billing period until canceled in accordance with your store's rules. If a trial or introductory offer is available and you accept it, the subscription changes to the price and billing period shown in the offer when that period ends unless you cancel in time. Eligibility is determined by the applicable offer and store.

For Apple purchases, renewal billing may occur during the 24 hours before the current period ends. Cancel at least 24 hours before the end of a free or discounted trial if you do not want it to renew. For Google Play purchases, cancel before the next renewal date shown by Google Play. Always check your store's cancellation deadline and confirmation.

Cancellation and restoration

You can manage or cancel your subscription through:

The app's Manage subscription action opens the relevant store when supported. Cancellation generally stops the next renewal and allows access through the already-paid period, subject to store rules. Trial access may end earlier under the relevant store's rules. The store will show the effective end date.

Deleting the app, choosing “Start over,” requesting deletion of data, or contacting support does not itself cancel a store subscription. Local reminders are not a guarantee of advance notice and do not change the store's billing schedule.

Use Restore purchases with the store account used for the original purchase to recover eligible access. Restoration depends on store records and product eligibility. Cross-platform transfer and Family Sharing are available only if expressly supported by the particular product; do not assume they are included.

Refunds, changes, and billing issues

Refund requests for store purchases are handled through the relevant store's procedures and applicable law. You may contact us for help identifying a purchase. Nothing in these Terms removes a statutory refund, cancellation, or other consumer remedy.

For future price changes, we and the store will provide any legally or contractually required notice and obtain agreement where required. You may cancel before the change takes effect. If we materially reduce or discontinue paid functionality, we will provide the notice and remedies required by law and the relevant store rules.

6. Permitted use and app rights

Subject to these Terms and the relevant store rules, you may use the Service for your personal, non-commercial household purposes. You may share meal plans and shopping lists through the provided features for those purposes.

The app's software, branding, designs, and content are owned by us or the relevant rights holders. Open-source components remain subject to their own licenses. Rights in your inputs are described in Section 4.

7. Device storage, third parties, and availability

Household data and saved plans are primarily stored on your device. Dayly does not currently provide an account-based household synchronization or cloud-backup service. A reinstall, reset, lost device, or storage problem may affect locally stored information. Export or share information you wish to keep using the available features.

Internet access is required for remote AI requests, subscription verification, and other network features. Local fallback content may be available during an outage, but it may differ from AI-generated content and may not cover every request. We do not promise uninterrupted availability or that every request will produce a result.

Apple, Google, Adapty, and apps you choose for sharing operate under their applicable terms and privacy practices. You are responsible for charges from your connectivity provider. Our use of third-party services does not remove our own obligations to you.

8. Suspension and termination

You may stop using Dayly at any time. Separately cancel any subscription through the relevant store if you want billing to stop.

We may restrict or suspend access where reasonably necessary to address a material breach, misuse, a security risk, a legal requirement, or discontinuation of the Service. Where practicable and lawful, we will give notice and an opportunity to address the issue. Urgent security or legal circumstances may require immediate action.

If your access ends, provisions that by their nature need to continue will continue, including payment obligations already incurred, intellectual-property provisions, applicable liability provisions, and dispute provisions. Any treatment of retained personal information remains subject to the Privacy Policy and applicable law. Your statutory remedies remain available.

9. Warranties and responsibility

We will provide the Service with the care and skill required by applicable law. Subject to that obligation and your mandatory rights, the Service and its suggestions are provided as available, without a guarantee of suitability for every household, accuracy of every result, or uninterrupted operation.

To the extent applicable law permits, we are not responsible for business losses arising from personal use of the Service, or losses that were not reasonably foreseeable when this agreement was made. Responsibility for other losses is determined under applicable law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where such liability cannot lawfully be limited, or any other liability or consumer guarantee that cannot lawfully be excluded. No food-safety statement in these Terms overrides that protection.

10. Apple App Store license

For the iOS app, the software license is governed by Apple's Standard Licensed Application End User License Agreement unless a separate custom EULA is expressly supplied through the App Store. These Terms supplement that license for the Dayly Service and do not purport to replace the Standard EULA.

The Dayly Service is provided by us. Direct Dayly service and support questions to the contact below; store billing questions and remedies may also be addressed through Apple. Mandatory store terms and applicable law control any conflict to the extent they require. Apple's Standard EULA does not apply to an Android download.

11. Disputes and general terms

Please contact fombo888@gmail.com if you have a concern so we can try to resolve it. You are not required to waive a legal claim or complete informal discussions before exercising a right that law makes available to you.

Applicable law determines the governing law and courts with jurisdiction over disputes about these Terms, subject to any controlling store-license provisions. You retain mandatory protections and any right to bring a claim in your local courts. These Terms do not impose mandatory arbitration or a class-action waiver.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally permitted. A delay in enforcing a provision does not by itself waive it. These Terms, the applicable store-license terms, and the purchase terms shown for your offer govern the corresponding aspects of your use.

12. Changes and contact

We may update these Terms to reflect changes in the Service or legal requirements. We will post the revised date and provide appropriate notice of material changes. Where law requires acceptance, we will obtain it. Changes will not retroactively remove rights or remedies you have already acquired.
